2. Scope of the terms and conditions
These Terms and Conditions govern access to the boothsafe.it website, the browsing of products and the purchase of BOOTHSAFE® products through the online store.

By placing an order through the website, the Customer confirms that they have read and accepted these Terms and Conditions, without prejudice to any mandatory rights granted to consumers under applicable law.

BOOTHSAFE® is a visual communication system designed for prevention and behavioral deterrence in DJ areas.

BOOTHSAFE® was created with the aim of promoting prevention, increasing public awareness and reducing, where possible, the need for verbal reminders from the DJ, staff or operators present in the area.

Its function is therefore preventive and based on visual deterrence: making the DJ area immediately recognizable and clearly communicating the need to pay attention to and respect the setup.

The product is designed to help keep the DJ area free from glasses, bottles, beverages and other objects that could interfere with the setup.

BOOTHSAFE® is not designed to physically cover the console or to act as a waterproof barrier between liquids and equipment.

Its presence does not guarantee that liquids, glasses or other objects cannot reach the console or equipment and does not replace supervision of the DJ area.

3. Product description
The characteristics, images, materials, dimensions and information relating to the products are provided on the relevant product pages of the website.

Product images are for illustrative purposes and may show minor differences compared with the physical product due to lighting conditions, screen display, materials, finishes or normal manufacturing tolerances.

Any specific product characteristics are indicated in the relevant product description and documentation available on the website.

4. Product use
BOOTHSAFE® must be used in accordance with the instructions and information provided by the Seller.

The Customer is responsible for ensuring that the product is positioned in a stable, safe manner and is compatible with the specific configuration of the DJ area.

BOOTHSAFE® must not be positioned in a way that interferes with faders, buttons, jog wheels, cables, connections or other operating parts of the console or equipment.

Before use, the Customer must verify that the product cannot fall, move or interfere with the equipment present.

5. Shopify platform
The website uses Shopify as the technological platform for managing the e-commerce store, product catalogue, shopping cart and purchasing process.

Shopify provides the technical infrastructure of the store, while the sale of BOOTHSAFE® products and related Customer support are managed by the Seller.

Services provided by Shopify or other third-party providers may be subject to their respective terms and conditions.

6. Prices
Product prices are those displayed on the website at the time of purchase.

Unless otherwise stated, prices are expressed in euros and include applicable taxes in accordance with current legislation.

Any additional shipping costs or other applicable charges will be indicated to the Customer before the order is completed.

In the event of an obvious pricing error, the Seller reserves the right to contact the Customer to verify the order before processing it or, where necessary, to cancel the order and refund any amount already paid.

7. Orders
The Customer may place an order by following the purchasing procedure available on the website.

Before completing the purchase, the Customer may review and correct the information entered.

Submitting an order creates an obligation to pay the price indicated during the purchasing process.

Order confirmation will be sent to the email address provided by the Customer.

The Seller reserves the right not to accept or to cancel an order in the event of product unavailability, obvious errors in the product description or price, inability to deliver the product, or other objective circumstances preventing fulfilment of the order.

If payment has already been made, the amount relating to the cancelled order will be refunded.

8. Payments
Payments for orders placed on the website may be processed through Shopify Payments and/or other payment service providers available on the Shopify platform, depending on the payment methods offered to the Customer at the time of purchase.

Payment information is processed in accordance with the procedures and security measures adopted by the relevant payment service provider.

The Seller does not directly store complete payment card details when such information is handled by the relevant payment service provider.

Payment services provided by third parties may be subject to their respective terms and conditions and privacy policies.

9. Shipping and delivery
BOOTHSAFE® currently ships exclusively to countries within the European Union.

Shipping methods, costs and estimated delivery times are indicated in the relevant Shipping Policy available on the website.

Delivery times may vary depending on the destination country, carrier, public holidays, operational conditions or other circumstances beyond the Seller’s direct control.

The Seller is responsible for delivery of the product in accordance with applicable law.

10. Shipments outside the European Union
Shipments to countries outside the European Union may be considered upon request.

Customers are invited to contact info@boothsafe.it before placing an order for delivery to a non-EU country, in order to verify whether shipping is possible and to agree the applicable conditions in advance.

Any customs duties, import VAT, taxes, customs clearance fees and other charges applicable in the destination country will be communicated and agreed with the Customer before shipment, according to the agreed delivery arrangements.

The Customer will be informed of any costs payable by them before completing the purchase.

11. Right of withdrawal
Consumers have the right to withdraw from an online contract within the period provided by applicable law, currently 14 days from delivery of the product, without having to provide a reason.

To exercise the right of withdrawal, the Customer must notify the Seller of their decision within the applicable period using the contact details provided on the website.

The product must be returned in accordance with the procedures indicated in the Return & Refund Policy.

The Customer is responsible for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning, to the extent permitted by applicable law.

Refunds will be made in accordance with applicable law and the relevant Return & Refund Policy.

The right of withdrawal does not affect the Customer’s rights under the statutory legal guarantee of conformity.

12. Voluntary 30-Day Return Policy
To provide greater peace of mind to our customers, BOOTHSAFE® offers a voluntary 30-day return policy from the date of delivery of the product, subject to the conditions set out in the Return & Refunds Policy.

The 30-day period constitutes an additional commercial benefit and does not modify or replace the statutory right of withdrawal provided under applicable law.

13. Statutory legal guarantee of conformity
BOOTHSAFE® products sold to consumers are covered by the statutory legal guarantee of conformity provided for under applicable law.

European Union legislation provides for a minimum two-year legal guarantee for consumer goods, without prejudice to any more favourable periods provided for by applicable national law.

In the event of a lack of conformity, the Customer may exercise the remedies provided by applicable law, including, where applicable, repair or replacement and, in the cases provided for by law, a price reduction or termination of the contract with a refund.

The statutory legal guarantee does not cover, to the extent permitted by law, damage resulting from improper use, use contrary to the instructions, unauthorised modifications or tampering, or other causes not attributable to a lack of conformity of the product.

Nothing in these Terms and Conditions limits or excludes mandatory consumer rights under the statutory legal guarantee.

14. Harmonised legal guarantee notice
The Seller provides the European Union harmonised legal guarantee notice on the website in accordance with applicable legislation.

From September 27, 2026, the harmonised notice is mandatory for online sales in the European Union and must be used in accordance with the format and content established by European legislation.

For sales concluded through an online interface, the harmonised notice must be displayed in accordance with the requirements established by European legislation.

15. Function and limitations of BOOTHSAFE®
BOOTHSAFE® is designed as a visual communication system for prevention and behavioral deterrence.

BOOTHSAFE®:

  • is not designed to physically cover the console or the entire setup;

  • does not constitute a waterproof barrier between liquids and equipment;

  • does not guarantee that liquids, glasses or other objects cannot reach the console;

  • does not necessarily prevent accidental spills;

  • does not eliminate the risk of damage to equipment;

  • does not replace supervision of the DJ area;

  • does not guarantee the integrity of equipment in every situation.

The function of BOOTHSAFE® is preventive and based on visual deterrence, with the aim of increasing public awareness, encouraging respect for the DJ area and reducing, where possible, the need for verbal reminders from the DJ, staff or operators present in the area.

Promotional communications relating to prevention and setup protection must be understood in the context of the product’s preventive and deterrent function and must not be interpreted as a guarantee of physical protection against liquids, impacts or other accidental events.

Nothing in this section limits the consumer rights provided by the statutory legal guarantee.

16. Customer responsibility for use
The Customer is responsible for the correct positioning and use of BOOTHSAFE® in accordance with the instructions provided.

Use of the product in a manner other than intended, incorrect positioning, or any modifications, alterations or tampering carried out by the Customer or third parties may compromise the proper use of the product.

The Customer must verify that BOOTHSAFE® is positioned securely and stably and does not interfere with equipment or operational activities.

To the extent permitted by law, the Seller is not responsible for consequences arising from improper, negligent or non-compliant use, or from modifications or tampering carried out by the Customer or unauthorised third parties.

This clause does not limit the consumer’s rights under the statutory legal guarantee of conformity.

17. Use on vibration-prone surfaces
BOOTHSAFE® may be used on different surfaces and positions, but product stability may vary depending on the surface, vibrations, dimensions and characteristics of the equipment on which it is placed.

Before using the product on subwoofers, speakers, flight cases, technical tables or other surfaces subject to vibration or movement, the Customer must carry out a preliminary stability check in the specific configuration.

The Customer must ensure that BOOTHSAFE® remains stable and cannot fall, move or interfere with other equipment.

Placement on subwoofers, speakers or other vibration-prone surfaces is carried out by the Customer after verifying the stability of the product in the specific configuration.

If adequate stability cannot be ensured, BOOTHSAFE® must not be used in that position.

Any falls, impacts, movement or breakage resulting from surface instability, vibrations, movement of the equipment or failure to carry out a preliminary stability check must be assessed according to the specific circumstances of the case and do not automatically constitute a lack of conformity of the product.

The statutory legal guarantee of conformity remains applicable where it is established that the issue results from a product defect existing prior to delivery.

18. Safety and risk of falling
BOOTHSAFE® must be positioned in a stable and safe manner and must not be placed in a position from which it could fall and cause injury or damage to people, equipment or other property.

When used on subwoofers, speakers or other surfaces subject to vibration or movement, the Customer must verify the stability of the product in the specific configuration and ensure that the positioning is suitable for the environment and conditions of use.

If adequate stability cannot be ensured, the product must not be used in that position.

The Customer must also periodically check product stability during use, particularly in the presence of vibrations, movement of the equipment or changes to the setup configuration.

The product must not be positioned in locations or configurations where a potential fall could reasonably create a risk to people.

These provisions do not exclude or limit any liability of the Seller or manufacturer that cannot lawfully be excluded under applicable product safety and defective product liability legislation.

19. Responsibility for the DJ area
The Customer remains responsible for the management, supervision and safety of their DJ area and the equipment being used.

BOOTHSAFE® is a visual communication, prevention and deterrence tool and does not replace supervision of the setup or the normal preventive measures adopted by the Customer.

The Customer must take all normal precautions necessary to protect their equipment and ensure the safety of the area according to the environment, type of event, presence of the public and operating conditions.

20. Accidental damage
Use of BOOTHSAFE® does not guarantee prevention of:

  • spills;

  • impacts;

  • falling objects;

  • contact between liquids and equipment;

  • movement or falls of the product caused by unstable or vibration-prone surfaces;

  • other accidental events.

The Seller does not guarantee that use of the product will completely prevent damage to equipment or people.

Nothing in this section limits the Seller’s liability where such limitation is not permitted by law.

21. Modifications and tampering
The product must not be modified, altered or tampered with from its original configuration.

To the extent permitted by law, the Seller is not responsible for consequences arising from modifications or interventions carried out on the product by the Customer or unauthorised third parties.

This clause does not limit the statutory legal guarantee of conformity provided by applicable law.

22. Intellectual property

BOOTHSAFE® is a registered trademark.

The BOOTHSAFE® trademark, its logo, product design, graphics, photographs, texts, visual elements and other content appearing on the website are protected by applicable intellectual property laws.

Unless expressly authorised by the rights holder, reproduction, distribution, modification, publication or commercial use of the trademark, logo, website content or identifying elements of BOOTHSAFE® is prohibited.

23. Website availability
The Seller endeavours to keep the website available and operational but cannot guarantee that the website will always be accessible without interruptions, errors or malfunctions.

The website may be temporarily suspended or restricted for maintenance, updates, technical interventions, network issues or other circumstances beyond the Seller’s direct control.

Such circumstances do not affect the consumer’s rights relating to orders already concluded.
